1.   CALL TO ORDER (ROOM 305)

 

2.   EXECUTIVE SESSION - The City Council has determined a necessity to
go into a closed to the public session under the provisions of Section
551, Texas Government Code, and the following topics may be discussed: 

 

*         under the authority of Section 551.074, personnel - discuss
appointment of individuals to quasi-judicial
boards/committees/commissions:  Board of Adjustment and Appeals, Board
of Sign Control and Appeals, Building and Standards Commission, Civil
Service Commission, Commissioners of Housing Authority, Historic
Landmark Commission, Planning and Zoning Commission and Zoning Board of
Adjustments;

*         under the authority of Section 551.072, deliberation about
real property - discussion regarding the lease of real property in
northwest Bryan for water production purposes;

*         under the authority of Section 551.087, deliberation regarding
economic development negotiations - discussion of offer of financial or
other incentives for development of a retail/commercial complex in east
Bryan, discussion of offer of financial or other incentives for
development in west Bryan, and discuss possible incentives for business
prospects to locate in the Bryan-College Station community.

Zoning, of the City of Bryan Code of Ordinances, as amended, changing
the zoning classification from an 'I' Industrial to a 'PD' Planned
Development district allowing a wholesale plant nursery, subject to
development requirements specified herein, on 3.93 acres of land out of
Zeno Phillips Survey A-45, located on the west side of the 2000 block of
Finfeather Road between Cottage Grove Circle and Northcrest Drive in
southwestern Bryan, Brazos County, Texas.

 

9.   PUBLIC HEARING - ZONING ORDINANCE AMENDMENT - OIL AND GAS WELL

      Receive public comment regarding an ordinance to amend Chapter
130, Zoning, of the City of Bryan Code of Ordinances, as amended, by
removing oil and gas well operations as a permitted use within the 'A-O'
Agricultural-Open District; providing for a penalty; providing for
publication; and providing for an effective date.

 

10.    PUBLIC HEARING - REINVESTMENT ZONE NUMBER TWENTY ONE

      Receive public comment regarding the designation of a tract of
land of approximately 259 acres in downtown Bryan within the corporate
limits of the City of Bryan, Texas, as a tax increment financing
district to be known as Reinvestment Zone Number Twenty One, City of
Bryan, Texas, establishing a Board of Directors for such reinvestment
zone, and ordaining other matters relating thereto.

Texas, amending Section 18-1 of the Bryan Code of Ordinances, defining
convenience stores and requiring convenience stores to meet specific
security camera and sign requirements; and placing responsibility on
convenience store managers and employees to ensure security cameras meet
certain criteria and are functional and in operation during store hours;
providing for a penalty; providing for publication; and providing an
effective date.

 

i.    Second and Final Reading of an Ordinance - Rezoning Request (RZ

      Second and final reading of an ordinance of the City of Bryan,
Texas, amending Chapter 130, Zoning, of the City of Bryan Code of
Ordinances, as amended, changing the zoning classification from a
combination of 'C-2' Retail and 'A-O' Agricultural Open districts to a
'PD' Planned Development district allowing single-family residential,
office and retail uses, subject to development requirements specified
herein, on 36.243 acres of land out of T.J. Wooten League A-59,
adjoining the northwest side of West Villa Maria Road between Mana Court
and Kingsgate Drive in far southwestern Bryan, Brazos County, Texas.

 

j.    Second and Final Reading of an Ordinance - Rezoning Request (RZ

Second and final reading of an ordinance of the City of Bryan, Texas,
amending Chapter 130, Zoning, of the City of Bryan Code of Ordinances,

for all lots within Briargrove Addition, Third Installment, Bryan,
Brazos County, Texas.

 

k.   Second and Final Reading of an Ordinance - Rezoning Request (RZ

      Second and final reading of an ordinance of the City of Bryan,
Texas, amending Chapter 130, Zoning, of the City of Bryan Code of

Residential District-5000 to 'R-NC' Residential Neighborhood
Conservation District for all lots within Lester's Windover Place #1,
Bryan, Brazos County, Texas.

 

12.    STATUTORY AGENDA

      This agenda consists of items previously approved by Council
action, such as adoption of items that are part of an approved budget or
capital improvement projects, first readings of ordinances, or action
which is required by law or delegated to the City Manager.  Items may be
removed from the statutory agenda at the request of two Councilmembers.

 

a.   Consideration - Agreement for Development and Tax Abatement for
Reinvestment Zone Number Twenty

      Consider approval of an agreement for development and tax
abatement for Reinvestment Zone Number Twenty for the benefit of
Weatherford Artificial Lift Systems, Inc. (WALS), designated for a tract
of land of approximately 16.134 acres out of the Brazos County
Industrial Park #3, known as 820 Industrial Boulevard.  The term of the
proposed tax abatement is for six years on a portion of the increase in
value of property with 0% to be granted in year 1, 80% in year 2, 60% in
years 3 and 4, 40% in year 5 and 20% in year 6.  In order for WALS to
receive the proposed abatement, they have agreed to invest $1,500,000 in
real property improvements and $23,500,000 in personal property by
December 31, 2008.  Additionally, WALS has agreed to maintain as a
minimum, an annual gross payroll in the amount of $3,000,000.  Source of
Funds:  Forgone Property Tax Revenue.

 

b.   Resolution - Procedures for Establishing Tax Increment Finance
Zones Within the City of Bryan

Adoption of a resolution of the City Council of the City of Bryan,
Texas, establishing Tax Increment Finance procedures and application for
public financial assistance for the City of Bryan.  This procedure
includes a formal application to be provided to the developer for
completion and an internal procedure to be followed by staff.  These
steps will be utilized in accepting the application and evaluating the
feasibility and costs/benefits to the City of Bryan of a proposed Tax
Increment Finance Zone.  This policy is to be administered in
conjunction with State Tax Code, Chapter 311, of the Tax Increment
Financing Act.  

 

c.   Resolution - Texas Institute for Preclinical Studies at Texas A&M
University <outbind://580/DO_NOT_OPEN/TIPSRes.doc>  - Hugh Walker

 

      Adoption of a resolution of the City Council of the City of Bryan,
Texas, affirming the City's commitment to support a community investment
incentive for the Texas Institute for Preclinical Studies (TIPS) at
Texas A&M University in partnership with the City of College Station and
Brazos County.  Source of Funds:  The funding source for $84,000
annually over five years, or $420,000 total, is the fund balance of the
General Fund.  

 

d.   First Reading of an Ordinance - Rezoning Request (RZ 06-37)

amending Chapter 54, Historical Preservation, of the City of Bryan Code

codifies the terms of uncodified Ordinance Number 877, which established
the Downtown Historical District and the standards governing exterior
alterations to property within said district.

 

g.   First Reading of an Ordinance - Reinvestment Zone Number Twenty One

            First reading of an ordinance of the City of Bryan, Texas,

         First Reading of an Ordinance - Tax Freeze

         First reading of an ordinance of the City of Bryan, Texas,
establishing an ad valorem tax freeze for residential homestead property
owners of the City of Bryan, Texas, who are 65 years of age or older or
who are disabled, to become effective with the 2007 tax year.  

 

         Available options:

 

1.   Approve the ordinance to adopt the tax freeze for disabled
individuals and individuals age sixty-five or older, with 2007 specified
as the effective year.  The maximum amount of taxes imposed on the
residence homestead of a disabled individual or an individual 65 years
of age or older will be the tax levy established on October 1, 2007.
Improvements to the individual's homestead, other than repairs, could
increase the base tax levy in a future year.

2.   Express the Council's intent to place the tax freeze question on
the ballot of a future election, to be conducted on a uniform election
date:  May 12 or November 6, 2007.

3.   Require the filing of a petition to place the tax freeze question
on the ballot of a future election, to be conducted on a uniform
election date.
