1.   CALL TO ORDER (Room 305)

 

2.   EXECUTIVE SESSION - The City Council has determined a necessity to
go into a closed to the public session under the provisions of Section
551, Texas Government Code, and the following topics may be discussed: 

 

*         under the authority of Section 551.071, consultation with
attorney - seek advice of legal counsel regarding the organizational
structure and function of the Bryan Business Council, Inc., and its
contractual relationship with the City of Bryan;

*         under the authority of Section 551.072, real estate -
discussion of acquisition of real estate in west Bryan for economic
development purposes; and 

*         under the authority of Section 551.074, personnel matters -
discuss the duties and responsibilities of city staff in response to
inquiries and requests from members of the Bryan City Council and to
discuss periodic review of protocols.

approving an amended development plan with modified landscape area
boundaries for a previously approved 'PD-B' Planned Development-Business
Zoning District on 44.59 acres of land out of the Richard Carter Survey,
A-8, adjoining the north side of the 3000 block of University Drive East
between State Highway 6 and Coppercrest Drive in far southeastern Bryan,
Brazos County, Texas.

c.   Consideration - Annual Price Agreement for Office Supplies

      Consider approval of an annual price agreement with OfficeMax
Contract, Inc. (Office Max), for the purchase of office supplies by all
city departments through Texas Multiple Award Schedule, a state
cooperative agreement, in an estimated annual expenditure amount of

from Hi-Way Equipment Company of Houston, Texas, in the amount of
$261,602.17 for the Transportation Department to perform creek
maintenance in areas too wet and muddy for other types of equipment.

amount of $67,197 through the Texas Building and Procurement Commission

Conservation District for all lots in the subdivision known as B.B.
Scasta Subdivision-Phase 2, Bryan, Brazos County, Texas.

 

14.   STATUTORY AGENDA

      This agenda consists of items previously approved by Council
action, such as adoption of items that are part of an approved budget or
capital improvement projects, first readings of ordinances, or action
which is required by law or delegated to the City Manager.  Items may be
removed from the statutory agenda at the request of two Councilmembers.

 

a.   Consideration - Amendment to Grant Agreement with Texas Department
of Transportation Aviation Division

            Consider approval of an amendment to a grant agreement with
the Texas Department of Transportation Aviation Division for the survey,
appraisal and land acquisition of property at Coulter Airfield.  The
amendment reflects the updated amount for the City of Bryan's share of
costs in this acquisition, which will be a remaining balance of
$338,838.  This item ratifies action taken by the Council on March 13,

c.   Consideration - Water Production Contract 3 - 54 inch Transmission

      Consider awarding a construction contract to Brazos Valley
Services for the Water Production Contract 3 - 54 inch Transmission
Line, Phase 1 project in an amount not to exceed $4,900,730, subject to
the submittal of required bonds and insurance.  Source of Funds:
$4,711,990 - 2005 and 2007 Water Revenue Bond Proceeds and $188,740 -

d.   Consideration - Change Order Number Three to the 24-Inch East Side
Water Main Project

      Consider approving change order number three with Brazos Valley
Services in an amount not to exceed $272,100 for the 24-Inch East Side
Water Main project.  The new contract amount is $3,204,779.56.  Source

e.   Resolution - Condemnation of Land

      Adoption of a resolution of the City Council of the City of Bryan,
Texas, declaring the public necessity and convenience for acquiring fee
simple title to a 50-foot wide strip of land lying and being situated in
the John H. Jones League, being part of the 76.74 acre tract described
in Volume 244, Page 357 of Deed of Records of Brazos County, Texas, more
particularly described in Exhibit "A" attached hereto, incorporated
herein and made a part hereof for all purposes, together with all right,
title and interest in accompanying easements owned by Oak Hills, Inc.,
for the public purpose and use of and for the location, construction and
operation of Heath Science Educational Facilities; ordering the
condemnation of said property in the name of the City of Bryan, Texas.

alleviate undesirable traffic conditions in the vicinity of

Highway 6 and Kent Street by, among other things, making turning lane
improvements and raised medians; and urging the Texas Department of
Transportation to assist the City in pursuing a study to identify future
measures or alternative traffic routes necessary to substantially
alleviate future undesirable traffic conditions.

 

c.   Resolution - Establishing an Economic Development Program
