1. CALL TO ORDER (Room 305)
2. EXECUTIVE SESSION - The City Council has determined a necessity to
go into a closed to the public session under the provisions of Section
551, Texas Government Code, and the following topics may be discussed:
* under the authority of Section 551.071, consultation with
attorney - seek advice of legal counsel regarding Bryan Municipal Golf
Course contract, seek legal advice regarding the possible acquisition of
land in central Bryan for economic development purposes, seek legal
advice regarding the development agreement between the City of Bryan,
Burton Creek Development and the U.S. Postal Service, and seek legal
advice regarding possible condemnation of ten tracts of land and
property interests in Grimes County, Texas, necessary to build the Twin
Oaks Landfill Project;
* under the authority of Section 551.087, economic development
negotiations - discussion regarding financial or other incentives for
Infinity Sports Entertainment, L.L.C., to continue and expand operations
at Travis Major Baseball Field.

7. PUBLIC HEARING - REINVESTMENT ZONE NUMBER TWENTY-FIVE
Receive public comment regarding a request to designate a tract
of land consisting of approximately 19.74 acres of land located within
the Stephen F. Austin League No. 9, and being all of that tract of land
conveyed from Moore Business Forms, Inc., to Conoco, Inc., recorded in
Volume 2302, Page 138, of the Official Records of Brazos County, Texas,
as Reinvestment Zone Number Twenty-Five for commercial-industrial tax
abatement as provided for in Chapter 312, Texas Tax Code Annotated;
establishing the duration of the district; and authorizing agreements
not to exceed ten years duration to exempt from taxation a portion of
the increase in value of property in order to encourage development and
redevelopment.
8. PUBLIC HEARING - REZONING REQUEST (RZ 07-44)
Receive public comment regarding a request to amend Chapter 130,
Zoning, of the City of Bryan Code of Ordinances, changing the zoning
classification from 'RD-5' Residential District-5000 to 'DT-N'
Downtown-North District on all land located at 300 West 24th Street,
being parts of Lots 3 through 5 in Block 142 of the Bryan Original
Townsite, Bryan, Brazos County, Texas.
9. PUBLIC HEARING - REZONING REQUEST (RZ 07-45)
Receive public comment regarding a request to amend Chapter 130,
Zoning, of the City of Bryan Code of Ordinances, changing the zoning
classification from 'RD-5' Residential District-5000 to 'DT-N'
Downtown-North District on all land located within Block 142 and the
western half of land located in Block 121 of the Bryan Original
Townsite, Bryan, Brazos County, Texas.
10. FIRST PUBLIC HEARING - OWNER REQUESTED ANNEXATION OF 121.8 ACRES
OF VACANT LAND
Receive public comment regarding a petition for annexation of 121.8
acres of vacant land out of Stephen F. Austin League No. 9, Abstract No.
62, and the Hezekiah Jones Survey, Abstract No. 145, Brazos County,
Texas, lying adjacent and contiguous to the present corporate limits of
the City of Bryan, near the intersection of Farm-to-Market Road 2818
(Harvey Mitchell Parkway) and Farm-to-Market Road 1687 (Sandy Point
Road).
11. CONSENT (AUTOMATIC APPROVAL) AGENDA
This agenda consists of ministerial or "housekeeping" items
required by law. Items may be removed from the consent agenda by
majority vote of the Council.
a. Approval of Minutes - Regular Meetings of December 11, 2007.
b. Consideration - Change Order Number Four to the Justice Center
Project
Consider approving change order number four to the Justice Center
Project contract in the amount of $29,298.23 for reductions to be
applied to the contingency allowance for owner modifications. Based
upon this application of funds to the contingency allowance, the
contract price will not increase. Source of Funds: 2004 and/or 2006
Certificates of Obligation proceeds.
c. Resolution - Advance Funding Agreement
Adoption of a resolution of the City Council of the City of Bryan,
Texas, authorizing the Mayor to execute an Advance Funding Agreement
with the State of Texas for proposed intersection work within the
rights-of-way of State Highway 6 (Earl Rudder Freeway) and
Farm-to-Market Road 158 (Boonville Road).
d. Resolution - Regional Concept for Interstate 69
Adoption of a resolution of the City Council of the City of Bryan,
Texas, expressing support of a regional concept for an alignment of
Interstate 69 by a study group of regional partners formed in response
to the anticipated release of a Draft Interstate 69 Environmental Impact
Statement. (Graphic)
e. Second and Final Reading of an Ordinance - Rezoning Request (RZ
07-43)
Second and final reading of an ordinance of the City of
Bryan, Texas, amending Chapter 130, Zoning, of the City of Bryan Code of
Ordinances, changing the zoning classification from 'A-O'
Agricultural-Open District to 'I' Industrial District on 1.59 acres of
land located at 2603 Clarks Lane within the Parkwood Estates
Subdivision, Bryan, Brazos County, Texas.
12. STATUTORY AGENDA
This agenda consists of items previously approved by Council
action, such as adoption of items that are part of an approved budget or
capital improvement projects, first readings of ordinances, or action
which is required by law or delegated to the City Manager. Items may be
removed from the statutory agenda at the request of two Councilmembers.
a. Consideration - Easterwood Airport Operations
Consider authorizing the Mayor to execute a Memorandum of
Agreement between the City of Bryan and Texas A&M University regarding
the City's financial contribution to Easterwood Airport operations in
the amount of $61,692. Source of Funds: General Fund - Payments to
Outside Agencies. (Agreement)
b. Consideration - Development Agreement with Burton Creek Development
Consider approving a development agreement between Burton Creek
Development, the United States Postal Service and the City of Bryan for
public improvements within Tax Increment Reinvestment Zone Number
Nineteen. The total City obligation under this agreement and within the
approved Tax Increment Reinvestment Zone Number Nineteen Project and
Finance Plan is $1,936,030. Source of Funds: 2005 Certificates of
Obligation.
c. Consideration - Infinity Sports Entertainment, LLC
Consider amending the Exclusive Facility Use Agreement between the
City of Bryan and Infinity Sports Entertainment, LLC, to allow for
parking lot/site improvements and a new public restroom facility for
Travis Major Baseball Field, in the estimated amounts of $150,000 and
$90,000, respectively. The City's portion of the cost for proposed
improvements is $90,000 for restrooms and $120,000 for parking lot
improvements, for a total not to exceed amount of $210,000. Source of
Funds: Single Member District 5 Parkland Dedication Fund - $136,000;
General Fund - Budget for Parks and Recreation Software - $18,000; and
Oil and Gas Revenues - $56,000.
d. Resolution - Twin Oaks Landfill Project
Adoption of a resolution and order of the City Council of the City
of Bryan, Texas, relating to the authority of the City to initiate,
complete and acquire through condemnation certain property interests in
certain real property located in Grimes County, Texas, for an authorized
and declared public purpose and use, being the expansion and improvement
of the City's municipal solid waste disposal and management system
through construction, operation and maintenance of a municipal solid
waste disposal facility and landfill; and a declaration that a public
necessity exists for the City to acquire the property and property
interests through condemnation in order to accomplish an authorized and
declared public purpose and use.
e. First Reading of an Ordinance - Street Closing (SC 07-01)
First reading of an ordinance of the City of Bryan, Texas,
providing for the abandonment and closing of an approximate 15-foot by
115-foot portion of an 80-foot right-of-way of South Randolph Street,
west of and adjacent to Block 190 of the Bryan Original Townsite; and
authorizing the Mayor to execute a quit claim deed to the abutting
property owner(s).
f. First Reading of an Ordinance - Reinvestment Zone Number
Twenty-Five
First reading of an ordinance of the City of Bryan, Texas,
designating a tract of land consisting of approximately 19.74 acres of

i. First Reading of an Ordinance - Hotel Occupancy Tax Reporting
Procedures
First reading of an ordinance of the City of Bryan, Texas,
amending Chapter 114, "Taxation", Article III, Hotel Occupancy Tax, of
the City of Bryan Code of Ordinances, by deleting Section 114-45,
"Reports" and adding a new Section 114-45 entitled "Reports and
Payments"; establishing procedures and requirements for reporting and
collecting hotel occupancy taxes similar to those used by the State of
Texas; requiring hotels with $500 per month or more, or $1,500 per
quarter, to report and pay monthly; providing for codification;
providing for publication; and providing an effective date.
j. First Reading of an Ordinance - Nuisance Violation Notice
Requirements
First reading of an ordinance of the City of Bryan, Texas,
amending Chapter 50, "Health and Sanitation", of the City of Bryan Code
of Ordinances, by amending Section 50-91, "Notice to Property Owners",
and removing the certified mail requirement as a method of notification.
