2. EXECUTIVE SESSION - The City Council has determined a necessity to
go into a closed to the public session under the provisions of Section
551, Texas Government Code, and the following topics may be discussed:
* under the authority of Section 551.071, consultation with
attorney - seek legal advice regarding the possible acquisition of land
in central Bryan for economic development purposes; and
* under the authority of Section 551.072, real estate - discussion
regarding the possible acquisition of land in central Bryan for economic
development purposes.

a. Approval of Minutes - Workshop and Regular Meetings of January
8, 2008.
b. Consideration - Annual Contract for Crushed Rock Flexible Base
Materials
Consider the award of an annual contract for crushed rock flexible
base materials to Brazos Site Works of Bryan, Texas, in an amount not to
exceed $174,950. Source of Funds: Transportation Department. (Bid
Tabulation)
c. Consideration - Purchase and Installation of Audiovisual Systems
for the Bryan Justice Center
Consider approving a contract with Electra Link, Inc., of Spring,
Texas, in the amount of $138,896.27, for the purchase and installation
of audiovisual systems for the Bryan Justice Center. Source of Funds:
2008 Certificates of Obligation. (Bid Tabulation)
d. Resolution - Ordering General Municipal Election
Adoption of a resolution authorizing a general (regular) municipal
election to be held on May 10, 2008, for the purpose of electing one
City Councilmember from Single Member District Number Three and one City
Councilmember from Single Member District Number Four, by the qualified
voters of the City of Bryan Single Member District Number Three and
Single Member District Number Four, respectively; authorizing a joint
election with the Bryan Independent School District to be held on May
10, 2008.
e. Second and Final Reading of an Ordinance - Street Closing (SC
07-01)
Second and final reading of an ordinance of the City of Bryan,
Texas, providing for the abandonment and closing of an approximate
15-foot by 115-foot portion of an 80-foot right-of-way of South Randolph
Street, west of and adjacent to Block 190 of the Bryan Original
Townsite; and authorizing the Mayor to execute a quit claim deed to the
abutting property owner(s).
f. Second and Final Reading of an Ordinance - Reinvestment Zone
Number Twenty-Five
Second and final reading of an ordinance of the City of Bryan,
Texas, designating a tract of land consisting of approximately 19.74
acres of land located within the Stephen F. Austin League No. 9, and
being all of that tract of land conveyed from Moore Business Forms,
Inc., to Conoco, Inc., recorded in Volume 2302, Page 138, of the
Official Records of Brazos County, Texas, as Reinvestment Zone Number
Twenty-Five for commercial-industrial tax abatement as provided for in
Chapter 312, Texas Tax Code Annotated; establishing the duration of the
district; and authorizing agreements not to exceed ten years duration to
exempt from taxation a portion of the increase in value of property in
order to encourage development and redevelopment.
g. Second and Final Reading of an Ordinance - Rezoning Request (RZ
07-44)
Second and final reading of an ordinance of the City of Bryan, Texas,
amending Chapter 130, Zoning, of the City of Bryan Code of Ordinances,
changing the zoning classification from 'RD-5' Residential District-5000
to 'DT-N' Downtown-North District on all land located at 300 West 24th
Street, being parts of Lots 3 through 5 in Block 142 of the Bryan
Original Townsite, Bryan, Brazos County, Texas.
h. Second and Final Reading of an Ordinance - Rezoning Request (RZ
07-45)
Second and final reading of an ordinance of the City of Bryan,
Texas, amending Chapter 130, Zoning, of the City of Bryan Code of
Ordinances, changing the zoning classification from 'RD-5' Residential
District-5000 to 'DT-N' Downtown-North District on all land located
within Block 142 and the western half of land located in Block 121 of
the Bryan Original Townsite, Bryan, Brazos County, Texas.
i. Second and Final Reading of an Ordinance - Hotel Occupancy Tax
Reporting Procedures
Second and final reading of an ordinance of the City of Bryan,
Texas, amending Chapter 114, "Taxation", Article III, Hotel Occupancy
Tax, of the City of Bryan Code of Ordinances, by deleting Section
114-45, "Reports" and adding a new Section 114-45 entitled "Reports and
Payments"; establishing procedures and requirements for reporting and
collecting hotel occupancy taxes similar to those used by the State of
Texas; requiring hotels with $500 per month or more, or $1,500 per
quarter, to report and pay monthly.
j. Second and Final Reading of an Ordinance - Nuisance Violation
Notice Requirements
Second and final reading of an ordinance of the City of Bryan,
Texas, amending Chapter 50, "Health and Sanitation", of the City of
Bryan Code of Ordinances, by amending Section 50-91, "Notice to Property
Owners", and removing the certified mail requirement as a method of
notification.
8. STATUTORY AGENDA
This agenda consists of items previously approved by Council
action, such as adoption of items that are part of an approved budget or
capital improvement projects, first readings of ordinances, or action
which is required by law or delegated to the City Manager. Items may be
removed from the statutory agenda at the request of two Councilmembers.
a. Consideration - Traditions Contract Eight Project
Consider award of construction contract to Brazos Valley Services for
the Traditions Contract Eight project in an amount not to exceed
$1,931,966.78. The Traditions Contract Eight project consists of the
extension of streets and utilities opening up the property south of the
current Traditions Golf Course for development and constructing a
portion of an east-west transportation corridor. Source of Funds: Tax
Increment Reinvestment Zone Number Ten Certificates of Obligation. (Bid
Tabulation)
b. Consideration - Joint Election Agreement
Consider authorizing the Mayor to sign an interlocal agreement between
the City of Bryan and Bryan Independent School District for a joint
election to be conducted on May 10, 2008. Source of Funds: City
Secretary's Election Budget.
c. Resolution - Accepting Petition Seeking Annexation
Adoption of a resolution of the City Council of the City of Bryan,
Texas, accepting a petition seeking annexation of 121.8 acres of land,
more or less, out of Stephen F. Austin League No. 9, Abstract 62 and the
Hezekiah Jones Survey, Abstract 145, in Brazos County, Texas, lying
adjacent and contiguous to the present corporate limits of the City of
Bryan; adopting a timetable for completing annexation; and directing the
City of Bryan Development Services Department to prepare a service plan
that provides for the extension of full municipal services to the area
to be annexed.
d. Resolution - Storm Water Program
Adoption of a resolution of the City Council of the City of Bryan,
Texas, authorizing the implementation of a storm water management
program for the City of Bryan to manage the quality of discharges from
the municipal separate storm sewer system.
e. First Reading of an Ordinance - Classification and Number of
Positions in the Fire Department
First reading of an ordinance of the City of Bryan,
Texas, repealing Ordinance No. 1721, adopted by the City Council
pertaining to classifications and number of positions in the Fire and
Police Departments pursuant to Chapter 143 of the Texas Local Government
Code; abolishing one Chief Inspector/Arson Investigator position and
replacing it with one Deputy Fire Marshal position in the Bryan Fire
